Terms of Service

1. Parties

"Packets," "we," "us," and "our" refer to BreakNCo Global Private Limited, a company incorporated in India with registered address at Building No.5/257A8, Suite No.188B, Heiley Offices, Ernakulam — 683104, Kerala. "Customer," "you," and "your" refer to the organisation or individual accepting these Terms.

2. Description of Services

Packets provides a compliance automation platform that helps organisations manage compliance programmes for frameworks including SOC 2, ISO 27001, GDPR, HIPAA, and others. The platform includes AI-powered features for risk generation, policy drafting, vendor assessment, evidence collection, and compliance monitoring.

3. Accounts and Access

• You must provide accurate and complete registration information and keep it updated
• You are responsible for maintaining the security of your account credentials and for all activity under your account
• You must notify us immediately of any suspected unauthorised access at admin@packets.build
• Each account may be used only by the authorised users of the customer organisation

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law or regulation
• Interfere with or disrupt the platform, servers, or networks
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure
• Upload or transmit malicious code, viruses, or harmful content
• Resell, sublicense, or redistribute access to the platform without authorisation
• Use the platform to store or process data in excess of your subscription entitlements
• Reverse engineer, decompile, or disassemble any part of the platform

5. AI Features

The platform includes AI-powered features. By using these features, you acknowledge that:

• AI-generated outputs are provided as drafts for human review and do not constitute legal, compliance, or professional advice
• You are responsible for reviewing and validating all AI outputs before use
• Your organisational data will be processed by our AI infrastructure as described in the Privacy Policy — Section 8
• You may opt out of AI features by contacting admin@packets.build

6. Intellectual Property

Packets owns all intellectual property rights in the platform, including software, design, trademarks, and content we create. You retain ownership of all data and content you upload to the platform. You grant Packets a limited licence to process your data solely to provide the services described in these Terms.

7. Payment Terms

Fees are as agreed in your subscription order. Unless otherwise stated, fees are due in advance, non-refundable (except as required by law or as specified in a written agreement), and exclusive of applicable taxes. Failure to pay may result in suspension of access after reasonable notice.

8. Confidentiality

Each party agrees to keep the other party's confidential information (including pricing, technical architecture, and customer data) strictly confidential and not to disclose it to third parties without prior written consent, except as required by law or as necessary to perform obligations under these Terms.

9. Data Protection

The processing of personal data is governed by our Privacy Policy and, for enterprise customers, our Data Processing Addendum (DPA). Where required by law, the DPA is incorporated into these Terms by reference.

10. Warranties and Disclaimers

Packets warrants that the platform will perform materially as described in the documentation. To the maximum extent permitted by applicable law, the platform is otherwise provided "as is" without warranty of any kind. We do not warrant that the platform will be uninterrupted or error-free, or that AI-generated outputs will be accurate or suitable for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Packets shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the fees paid by you in the twelve months preceding the event giving rise to the claim.

12. Termination

Either party may terminate for material breach on 30 days' written notice (with an opportunity to cure within that period). We may suspend or terminate access immediately for violation of the Acceptable Use provisions or non-payment after notice. On termination, your access will cease and your data will be retained and deleted per our Privacy Policy — Section 9.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Ernakulam, Kerala, India. The parties agree to first attempt resolution through good-faith negotiation for 30 days before commencing legal proceedings.

14. Changes

We may update these Terms from time to time. For material changes, we will provide 30 days' advance notice by email to the primary account address. Continued use of the platform after the effective date of changes constitutes acceptance.
